All nanoCom products are not for
use of children under 13 years of age. If it comes to the attention
of nanoCom Corporation through a reliable means, determined
by nanoCom Corporation, that a registered or unregistered
user is a child under 13 years of age, nanoCom will cancel
that user's account without refund.
nanoCom develops software that, like most Internet applications,
is vulnerable to various security issues and should be considered
unsecure. By using Internet communication software, such as
nanoCom software, you may be subject to:
- Exposure to objectionable material
and/or parties
- Information and materials listed or sent, on
or through the BuddyVision/nanoCom system, may be exposed to
other other users of the software, the general public
or any other entity for which the information was not intended.
In all Internet applications of this kind, the IP address
of the sender and receiver is a vital part of the TCP/IP standard
protocol of the Internet. Any party to the communication session
using certain software and/or hardware can extract your IP
address.
Use of nanoCom software, website, online materials,
servers, directories, databases or tools related to or part of
the BuddyVision or nanoCom system are subject to the terms and conditions
of the license agreement that accompanied nanoCom software,
any updates of nanoCom software, and the nanoCom Corporation
Privacy Policy.

Privacy and Security Issues
Unless produced by nanoCom Corporation, information that
you access or receive by using nanoCom software, information
sent to you directly by other users, entered or posted by
the users is not reviewed, controlled, examined, verified,
endorsed or stored by nanoCom Corporation unless specified
below. There are two ways that end-users can receive information
by using nanoCom software; direct communication or indirect
communication.

Direct Communications
A direct communication is when one user's data is sent to
and received directly by another user. These communications
are deliberate on the part of the sending end user. Direct
communication information is not reviewed, controlled, examined,
verified, endorsed or stored by nanoCom Corporation. Direct
communications include:
- Videochats
- Visual Instnat Messages

Indirect Communications
An indirect communication is sent to an end-user by another
end-user, but is routed or stored on a nanoCom system or server.
Indirect communications include:
- BuddyIcon - BuddyIcon images are
stored locally on the users computer, but at the time of
log-on are momentarily sent through a nanoCom Server, but
are not stored.
- V-Mail - V-Mail images are stored on the nanoCom/BuddyVision
system, but are not viewed, review or monitored by nanoCom
or any of its employees. The images are assigned a long
unique serial number and are not identified by sender or
receivers email address. V-Mail text is sent directly to
the receiver and is not stored on the nanoCom/iSpQ servers.
nanoCom does not keep the email addresses that are sent
through the system and will not use them in any way.
Information that is available to nanoCom Corporation includes
usage of the system according to IP address, user name, time
of entrance, time of exit, user usage history, program serial
number, software version number and registration information.
nanoCom will permit authorized officers of the court access
to all available and relevant information to comply with valid
legal process such as a search warrant, subpoena, or court
order. In addition, nanoCom will authorize officers of the
court access to protect nanoCom Corporations rights and property
or in special emergencies when we believe physical safety
is at risk. Users IP and dynamic IP address may be traced
by nanoCom and disclosed for these purposes only.

Information Collection and Use
nanoCom Corporation is the sole owner of the information
collected on this site. We will not sell, share, or rent this
information to others in ways different from what is disclosed
in this statement. nanoCom Corporation collects information
from our users at several different points on our website.

Installation
When BuddyVision is installed the name of the camera on
the computer and the operating system are anonymously reported.
The information is no way linked to any personally identifiable
information.

Registration
In order to download nanoCom software, a user must first
complete the registration form. During registration, a user
is required to give their contact information (such as name
and email address). This information is used to contact the
user about the services and software for which they have expressed
interest. It is optional for the user to provide demographic
information (such as income level and gender), but encouraged
so we can provide better services and software.

Order
We request information from the user on our order form. Here
a user must provide contact information (such as name and
shipping address) and financial information (such as credit
card number, expiration date). This information is used for
billing purposes and to fill customer's orders. If we have
trouble processing an order, this contact information is used
to get in touch with the user.

Cookies
A cookie is a piece of data stored on the user's hard drive
containing information about the user. Usage of a cookie is
in no way linked to any personally identifiable information
while on our site. Once the user closes their browser, the
cookie simply terminates. For instance, by setting a cookie
on our site, the user would not have to log in a password
more than once, thereby saving time while on our site. If
a user rejects the cookie, they may still use our site. Cookies
can also enable us to track and target the interests of our
users to enhance the experience on our site.

Log Files
We use IP addresses to analyze trends, administer the site,
track user's movement, and gather broad demographic information
for aggregate use. IP addresses are not linked to personally
identifiable information.

Sharing
We will share aggregated demographic information with our
partners and advertisers (such as number of hits, unique visitors,
number of males and female). This is not linked to any personal
information that can identify any individual person.
We use an outside shipping company to ship orders, and a
credit card processing company to bill users for goods and
services. These companies do not retain, share, store or use
personally identifiable information for any secondary purposes.
We may/do partner with other parties to provide specific
services. When the user signs up for these services, we will
share names, or other contact information that is necessary
for the third party to provide these services. These parties
are not allowed to use personally identifiable information
except for the purpose of providing these services.

Surveys & Contests
From time-to-time, our site requests information from users
via surveys or contests. Participation in these surveys or
contests is completely voluntary and the user therefore has
a choice whether or not to disclose this information. Information
requested may include contact information (such as name and
shipping address), and demographic information (such as zip
code, age level). Contact information will be used to notify
the winners and award prizes. Survey information will be used
for purposes of monitoring or improving the use and satisfaction
of this site. Tell-A-Friend If a user elects to use our referral
service for informing a friend about our site, we ask them
for the friend's name and email address. nanoCom Corporation
will automatically send the friend a one-time email inviting
them to visit the site. nanoCom Corporation stores this information
for the sole purpose of sending this one-time email. V-Mail
Email Receiver Email Address nanoCom does not keep the email
addresses that are sent through the system and will not use
them in any way.

Security
This website takes every precaution to protect our users'
information. When users submit sensitive information via the
website, your information is protected both online and off-line.
When our registration/order form asks users to enter sensitive
information (such as credit card number and/or social security
number), that information is encrypted and is protected with
the best encryption software in the industry - SSL, unless
otherwise noted. While on a secure page, such as our order
form, the lock icon on the bottom of Web browsers such as
Netscape Navigator and Microsoft Internet Explorer becomes
locked, as opposed to un-locked, or open, when you are just
'surfing'.
While we use SSL encryption to protect sensitive information
online, we also do everything in our power to protect user-information
off-line. All of our users' information, not just the sensitive
information mentioned above, is restricted in our offices.
Only employees who need the information to perform a specific
job are granted access to personally identifiable information.
Our employees must use password-protected computers when they
leave their desk. All employees are kept up-to-date on our
security and privacy practices. Any time new policies are
added, our employees are notified and/or reminded about the
importance we place on privacy, and what they can do to ensure
our customers' information is protected. Finally, the servers
that we store personally identifiable information on are kept
in a secure environment.

Special Offers
We send all new members welcoming emails to inform them of
trial time, services and special offers. Established members
will occasionally receive information on products, services,
upgrades and special deals. Out of respect for the privacy

Site and Service Updates
We also send the user site and service announcement updates.
Members are not able to un-subscribe from service announcements,

address), or if a user no longer desires our service, we will

Our users are given the opportunity to
'opt-out' of having their information used for purposes not
directly related to our site at the point where we ask for the
information. For example, our order form has an 'opt-out'
mechanism so users who buy a product from us, but don't want
any marketing material, can keep their email address off of
our lists. Users who no longer wish to receive promotional
materials from our partners may opt-out of receiving these

Users of our site are always notified
when their information is being collected by any outside parties.
We do this so our users can make an informed choice as to
